Mesothelioma Trust Funds

In many cases, being struck by any form of cancer leaves a patient with a feeling of helpless and often no way to pinpoint the cause of their illness; even perfectly healthy individuals can succumb to multiple forms of this disease. Mesothelioma, by contrast, is a form of cancer that is caused by the inhalation of asbestos fibers, typically in a work setting and over a long period of time. These fibers can become stuck in the lining of the heart, abdomen or lungs and can cause the abnormal division of cells, leading to cancer. In cases where a workplace using asbestos is the cause of cancer, it may be possible for patients to recover part or all of their medical costs from companies, along with compensation for their suffering. This recompense can take the form of either a payment from the company after a lawsuit or from a mesothelioma trust fund that has been created specifically for that purpose.

A large number of the companies that produced and used asbestos in the first part of the 20th century are now out of business or have filed for Chapter 11 bankrupt, leaving them insolvent. Some have created mesothelioma trust funds that patients can access so long as they can demonstrate that their mesothelioma comes as a result of work-related exposure. These trust funds are an alternative to other legal solutions which either see companies paying out of pocket or going through a lengthy court process to determine fault. These funds also allow companies to dodge the question of responsibility and simply pay those who have been affected.

National Trust Fund

Over the last few decades, a number of initiatives have come before congress aimed at creating a national trust fund for mesothelioma sufferers, one that companies who used, produced or shipped asbestos would be required to pay into on a regular basis. Unfortunately, many of the solutions that congress has been shown are severely under-funded and do not adequately anticipate the number of people who will potential make claims on the fund. The recently created Johns-Manville trust fund shores up these issues - it has already suspended its operations twice and severely reduced the amount that it pays out to those that have legitimate mesothelioma claims.

Mesothelioma trust funds are a viable solution to the problem of asbestos-related cancers and can go a long way to helping patients not only fund their care but leave behind a legacy for their families. While congress-approved trust funds are not yet in place, more and more companies are choosing to create funds that can be accessed with proof of work-related mesothelioma, giving patients a chance at fair compensation.
